Hans Kelsen: On the Essence and Value of Democracy

On 26 November 2025, Stakes of Democracy hosted the first in a series of seminars exploring the nature, values and workings of democracy. The seminar centred on Hans Kelsen’s On the Essence and Value of Democracy, a modern classic of democratic theory.

Taking the question of how democracy can be defended in times of crisis as its point of departure, the seminar discussed Kelsen’s understanding of democracy’s fundamental principles and values, and considered the text in light of contemporary democratic challenges.

Marius M. Kjølstad, Associate Professor of Legal History at the University of Oslo and translator of the Norwegian edition, presented the book. Sverre Flaatten, Professor of Sociology at the Norwegian Police University College, commented on the text, with particular attention to the relationship between Kelsen and Max Weber.
