Legal systems use divergent and contradictory definitions of credibility, illustrated by recent examples from the apex courts of the United States, Canada, and Norway. Combining concepts from legal analysis and legal psychology presents a way forward. First, it is noted that psychology has largely studied intuitive initial judgments of credibility, whereas legal evaluations of credibility are generally deliberative and considered. Combining both approaches with the theoretical distinction in legal psychology between the credibility of a person and the reliability of their testimony, a preliminary model is proposed that describes the ways in which a reliability assessment can diverge from a credibility assessment. Because reliability also consists of an assessment, it is therefore subject to the weaknesses of human reasoning and can be mistaken, or, in the model’s terms, not in accordance with the factual truth. The model links thinking about credibility and reliability with the relevant literature from legal psychology. (PsycInfo Database Record (c) 2026 APA, all rights reserved)

Ben-Shakhar and Verschuere (2024) commented on Brennen and Magnussen's (2023) review of the literature on lie detection. They argued that the review's conclusion that such methods are not ready for forensic use is too pessimistic and that they already are in use worldwide. While we agree that many jurisdictions do in fact use such methods, we see this as cause for alarm rather than confirmation of their utility. It is documented that several lie detection methods distinguish to a statistically significant degree between deceitful and truthful statements, but they also have substantial error rates. This means that applying them at the level of the individual statement will frequently be misleading, making them unsuited to guiding police investigations.

A reliable lie-detection method would be extremely useful in many situations but especially in forensic contexts. This review describes and evaluates the range of methods that have been studied. Humans are barely able to pick up lies on the basis of nonverbal cues; they do so more successfully with systematic methodologies that analyze verbal cues and with physiological and neuroscientific methods. However, the rates at which people are able to detect lies are still well below the legal standard of “beyond a reasonable doubt.” This means that the utmost caution must be exercised when such methods are employed. In investigations where independent evidence exists, there is emerging evidence that interviews based on a free account followed by the gradual introduction of the evidence by investigators can reveal inconsistencies in a guilty interviewee’s account. Automated machine-learning methods also hold some promise.

Professional use of external retrieval cues, such as various types of visual aids, has been utilized in investigative interviews of children for decades based on the assumption that aids can facilitate children’s recollection of abusive incidents. Although analog studies and surveys have provided insight into various aspects of visual aid utilization, there is a scarcity of field studies that addresses the use of visual aids in large samples of authentic investigative interviews of preschool-aged children. In the present study, the use and productivity of visual aids were examined in 140 investigative interviews of 3- to 6-year-old children, all of whom disclosed abuse in cases that progressed to prosecution. The exploratory analyses focused on the overall use of visual aids, the types of questions posed along with visual aids when the interviewer directly asks questions regarding the investigated incident(s), and the extent to which the children provided forensically relevant information in response to questions used along with visual aids. It was found that visual aids were utilized to elicit information regarding the investigated incident(s) in 92% (n = 129) of the interviews, with emotion cards and drawing materials being the most common aids used. The highest proportion of questions asked alongside visual aids were directive (41.6%) and option-posing (37.3%) questions, followed by suggestive questions (17.9%), and a rather low proportion of open-ended invitations (3.2%). In addition to visual aids, open-ended invitations elicited the most forensically relevant information from the interviewees. The need for standardized guidelines and specialized training for the use of visual aids in investigative interviews of young children is discussed.

Faulty eyewitness testimony can be a notorious source of mistakes in the legal system potentially leading to wrongful convictions and miscarriages of justice. The current study examined the knowledge of a sample of police officers (n = 270) and psychologists (n = 63) in Indonesia regarding factors known to influence the validity of eyewitness testimony given by adults and children. Previous studies have documented that police and psychologists in Western countries have less-than-optimal knowledge about the psychology of eyewitness testimony. Similarly, our non-Western sample also demonstrated a lack of knowledge that may be damaging in the legal context such as the belief that recall of minor details indicates accuracy of memory. For both adult and child eyewitnesses, the psychologists performed significantly better than the police but at the item level these differences were small in size. Intriguingly, we also found that psychologists were more likely than the police officers to endorse the item about repression of memories. The findings show the need for teaching on the psychology of eyewitness testimony for professional groups involved in the legal arena.

Do surveillance shots and phantom drawings of the perpetrator in child abuse cases, images that are widely published in public media, contaminate the identifications made by young victims? This question was raised in the later phases of the investigations into a Norwegian child abuse case that involved a large number of victims, where a suspect was apprehended, and a photo lineup with the victims was planned. The police sought to answer the question by conducting a simple experiment: Two samples of participants – children in the age range of the real victims but from a different part of the country, and police cadets – were presented with the published photographs and drawings of the suspect; after a short interval, they were asked to pick the man they had seen in a 12-person photo lineup that was planned to be used with the real victims. The results showed that media exposure – surveillance shots and phantom drawings – in this case did not increase the probability of selecting the suspect. It is concluded that criminal investigations in some cases may profit from research evaluations of police procedures and eyewitness performance, supporting the investigative process by sorting out unreliable procedures and increasing the quality of the evidence.

This study examined the quality of forensic interviews conducted by specially trained police officers in the Norwegian Barnahus between 2015 and 2017, using the sequential interview (SI) model, a Norwegian version of the extended interview model that has not previously been studied. Two hundred and seven interviews of alleged abused preschool children (3–7 years old) were selected from around the country. Developmental trends in interview dynamics and the pattern of disclosure were analyzed. Analyses showed that the interviews were long but involved few open-ended and many suggestive questions, especially in interviews with the youngest children who did not disclose. Because similar findings were obtained in previous studies of Norwegian interviews not using this model, the findings suggest that the SI interview model does little to improve the formal quality of forensic interviews with very young children, and show the need to develop new forms of interviewer training which are more intensive than those currently employed.

Eyewitness evidence often plays a critical role in decisions made in the criminal justice system. To evaluate eyewitness testimony accurately, judges must be aware of factors that can contaminate this type of evidence. In 2008, a survey of judges in Norway revealed a lack of awareness of several factors that affect eyewitness testimony. In the current study, a survey was administered to Norwegian judges (N=98) to evaluate their knowledge of factors that affect eyewitness testimony. Results showed that judges’ overall knowledge scores were similar to those reported in 2008, but substantial increases and decreases in knowledge were observed for specific factors. Additional analyses indicated that increased uncertainty regarding some eyewitness factors led to a decline in accuracy when compared to responses observed in 2008. The current study provides an updated assessment of judges’ knowledge of eyewitness factors and highlights the need for more comprehensive training for judges regarding these factors.

The emotional witness effect – the phenomenon whereby people are affected by the emotional manner in which a witness presents testimony – constitutes a possible source
of wrongful decisions in legal contexts. One stereotypical view of abused children is that they should be sad when talking about their experiences of maltreatment, whereas children may in fact express a variety of emotional expressions when talking about abusive events. This raises the question as to whether there is an optimal mode in which to present child victim testimony that could reduce the possible influence of displayed emotions. In the present study, mock police interviews were carried out with female
child actors, role-playing the victims of physical abuse by their stepfather, telling the same story with four emotional expressions (neutral, sad, angry, or positive). Laypersons
(N = 465) were presented with the interviews as transcripts with the emotional reactions of the child witness noted, audio recordings, or videotaped recordings.
Participants then rated the credibility of the victim witness. Replicating previous results, the “sad” expression elicited the highest credibility ratings across all modes of
presentations. Presentation mode affected ratings of credibility, with the transcript versions resulting in the highest ratings.

Rettspsykiatrien har siden fagfeltets begynnelse
på 1800-tallet vært gjenstand for debatt, kritikk
og kontroverser. Debattene har gjerne oppstått i
tilknytning til høyprofilerte og vanskelige saker som
f.eks. 22. juli-saken i 2012. Denne boken går i dybden av
rettspsykiatrien.
vesen stilles under lupen.

Recent studies have demonstrated that retinotopic cortex maintains information about visual stimuli during retention intervals. However, the process by which transient stimulus-evoked sensory responses are transformed into enduring memory representations is unknown. Here, using fMRI and short-term visual memory tasks optimized for univariate and multivariate analysis approaches, we report differential involvement of human retinotopic areas during memory encoding of the low-level visual feature orientation. All visual areas show weaker responses when memory encoding processes are interrupted, possibly due to effects in orientation-sensitive primary visual cortex (V1) propagating across extrastriate areas. Furthermore, intermediate areas in both dorsal (V3a/b) and ventral (LO1/2) streams are significantly more active during memory encoding compared with non-memory (active and passive) processing of the same stimulus material. These effects in intermediate visual cortex are also observed during memory encoding of a different stimulus feature (spatial frequency), suggesting that these areas are involved in encoding processes on a higher level of representation. Using pattern-classification techniques to probe the representational content in visual cortex during delay periods, we further demonstrate that simply initiating memory encoding is not sufficient to produce long-lasting memory traces. Rather, active maintenance appears to underlie the observed memory-specific patterns of information in retinotopic cortex.

Academics and researchers from the Nordic countries (Sweden, Iceland, Norway, Finland) have made a particularly strong contribution internationally to the rapidly developing disciplines of forensic and legal psychology. This book brings together the leading authorities in the field to look systematically at the central issues and concerns of their subject, looking at both investigative psychology and psychology in court. This book reflects the results of research in the Nordic countries themselves, but each chapter is at the same time concerned to situate their work within a broader comparative and international context. The book is a major contribution to the subject, and will be essential reading for anybody with interests in this field.
